CONSUMER DISCLOSURES:
The following promotion is intended for play in Canada only, excluding Québec, and will be construed according to Canadian law. Please do not enter if you are not located in Canada.
1. HOW TO ENTERNO PURCHASE OR PAYMENT NECESSARY TO ENTER. ENTRANTS MUST HAVE REACHED THE AGE OF MAJORITY. Contest begins on March 3, 2009, and ends on May 15, 2009. To participate, send an email to saltspringcontest@bcmag.ca prior to 11:59 PM Pacific Time, May 15, 2009 with “SALTSPRING ISLAND GETAWAY CONTEST“ in the subject line and state your full name, mailing address, daytime phone number, and email address (optional) in the body of the email and you will automatically receive one entry. Participation in this Contest constitutes contestant’s full and unconditional agreement to and acceptance of these Official Contest Rules. Participants who do not comply with these rules are subject to disqualification.
Limit one entry per person regardless of method of entry.
2. NO PURCHASE NECESSARY
To enter without using email, hand-print your name, complete address, daytime telephone number, and date of entry on a 5“ x 7“ plain piece of paper, sign the paper, and mail it to: Saltspring Island Getaway Contest, British Columbia Magazine, 300-1803 Douglas Street, Victoria, BC, Canada, V8T 5C3. Mail-in entries must be postmarked by May 15, 2009, and received by May 25, 2009. Entries become the property of British Columbia Magazine (“Sponsor“), a division of Tourism British Columbia, and will not be returned.
3. ELIGIBILITY
Entrants must be legal Canadian residents, excluding residents of Québec, who have reached the age of majority in their province of residence as of March 3, 2009. Employees of Sponsor, its affiliates, marketing partners, suppliers, advertising or promotional agencies, and the immediate family members (mother, father, brother, sister, son, daughter, spouse) of, or persons residing in the same household as, any such person, are not eligible. All federal, provincial, and local laws and regulations apply.
4. PRIZE
There is one (1) grand prize available to be won, consisting of: a CDN $200 gift card for accommodation at Harbour House Hotel (121 Upper Ganges Road, Saltspring Island, BC, V8K 2S2; Telephone: (250) 537-5571 or toll-free 1 (888) 799-5571; www.saltspringharbourhouse.com; email: harbourhouse@telus.net) plus $50 in Salt Spring Dollars (actual value: CDN $50), redeemable at some 169 local businesses on Salt Spring Island (http://saltspringdollars.com/who-accepts-ss/).
In conjunction with the winner’s visit to Saltspring Island resident artist Nick Bantock for a personal tour of the artist’s The Forgetting Room Gallery-Studio on Saltspring Island, subject to scheduling and availability of the artist.
The prize must be used prior to December 31, 2009, and accommodation is subject to availability at Harbour House Hotel at time of booking.
Chances of winning depend on the number of eligible entries received. The approximate retail value of the grand prize is $250.00 CDN.
Taxes, if any, related to the prize are the responsibility of the individual winner. Prize consists of gift certificate and Salt Spring Dollars only; any and all costs associated with the use thereof by the winner, including but not limited to travel and meals and other travel expenses, are the sole responsibility of the winner.
5. SELECTION OF WINNERS
On or about May 30, 2009, a random draw will be conducted by the Sponsor or its designee, the judges of the Contest, to select one (1) entry from all eligible entries received. Odds of winning are dependent upon the total number of eligible entries received. The Sponsor or its representative will attempt to contact the selected entrant by phone once per day for five (5) business days. If selected entrant can not be contacted after five (5) business days, or is contacted but is deemed to be ineligible in the Sponsor’s sole discretion, or unable or unwilling to comply with these rules, that selected entrant will be disqualified and another entry will be drawn. This process may be repeated until one (1) entrant has been declared a winner.
Before being declared a winner, the selected entrant must first correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered by telephone at a time mutually convenient for the entrant and Sponsor or promotional agent of Sponsor.
6. NAME OF PRIZE WINNER
For the name of the prize winner, send a self-addressed stamped envelope with this request in writing to: , British Columbia Magazine, 300-1803 Douglas Street, Victoria, BC, Canada, V8T 5C3, by May 30, 2009.
7. RELEASE
Within fourteen (14) days of receipt thereof, the selected entrant will be required to sign and return the Contest Sponsor’s declaration and release form confirming compliance with Contest Rules and acceptance of prize as offered; acknowledging the non-responsibility of the Sponsor, its agents, and the prize suppliers in respect to injuries, accident, loss or misfortune relating to the Contest or the awarding of the prize; and, except where prohibited, acknowledging the Sponsor’s and its agents’, subsidiaries’ and affiliates’ right to publish and/or broadcast the winner's picture, name, address, voices and/or statements without further compensation other than the prize offered. If prize documents are not returned within fourteen days, prize will be forfeited and awarded to an alternate entrant.
8. ERRORS, ETC.
The Sponsor is not responsible for (i) lost, late, incomplete, postage due, illegible, damaged, destroyed or misdirected mail/entries; (ii) telephone, technical, network, online, electronic, computer hardware or software failures of any kind; (iii) incomplete, garbled or delayed Internet/email computer transmissions on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof; (iv) any condition caused by events beyond its control which disrupts or interferes with the Contest; or (v) any injury, loss or damage of any kind arising out of participant's participation in the Contest or the acceptance, possession or use of the prize, including without limitation any injury or damage to participant's or any other person's computer relating to or resulting from participation or downloading any materials in this Contest.
The Sponsor extends absolutely no representations or warranties in respect of the prize. If for any reason the Contest is not capable of running as planned or if the administration, security, fairness, integrity, or proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond its control, the Sponsor reserves the right to cancel, terminate, modify or suspend the electronic portion of the Contest, including canceling any method of entry, and randomly select the winner from previously received entries.
The Sponsor reserves the right to amend the terms of this Contest without prior notice if any factor interferes with its proper conduct as contemplated by these Rules.
9. MISCELLANEOUS
Prize is not transferable and must be accepted as awarded with no substitutions, whether in cash or otherwise, except at the Sponsor’s sole discretion. The Sponsor reserves the right to substitute a prize of equivalent or greater value if the prize cannot be awarded as described for any reason. Prize will only be awarded to verified winner. All decisions of the Sponsor or their authorized representatives are final and binding in all matters relating to this Contest. In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the person whose name appears on the emailed Contest entry.
